1. Acceptance of terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and YourPottyPal (“we,” “us,” or “the Company”), a company registered in the State of Florida, United States. By downloading, installing, accessing, or using the YourPottyPal mobile application (the “App”) or the website at yourpottypal.com (the “Website”, and together with the App, the “Service”), you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including parents, caregivers, and professionals. You represent and warrant that you are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of the Service

YourPottyPal is an AI-powered companion application designed to support parents and caregivers during the potty training process. The Service provides tools including but not limited to:

  • Potty training logging with multiple event types
  • Smart reminder and timer systems
  • AI-powered coaching tips and pattern detection
  • Provider escalation alerts (automated informational prompts)
  • Gamification with celebrations, token boards, and achievement systems
  • Data exports (CSV and PDF reports) for sharing with healthcare providers
  • Voice Studio for custom audio recordings (stored on-device only)
  • Multi-child profile support
  • Caregiver collaboration features
  • iOS widgets, Live Activity, and Siri Shortcuts
  • Adaptive support toolkit (visual schedules, communication boards)

3. Not medical advice — important disclaimer

PLEASE READ CAREFULLY: YourPottyPal provides general educational information and wellness-oriented coaching to support potty training. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. The App does not replace the advice of a qualified healthcare professional.

Specifically:

  • AI-generated coaching tips, pattern detections, and provider escalation alerts are informational suggestions only — they are not clinical recommendations, prescriptions, or diagnoses
  • The App does not assess, treat, cure, mitigate, or prevent any medical condition, disease, or disorder
  • Every child develops differently — the App does not guarantee specific outcomes, timelines, or results
  • Provider escalation alerts (e.g., suggestions to contact a pediatrician) are automated pattern-matching prompts, not clinical assessments
  • You are solely responsible for all decisions regarding your child's health, development, and care
  • If you have concerns about your child's health or development, consult a qualified healthcare professional
  • In a medical emergency, call your local emergency number immediately

By using the Service, you acknowledge and agree that you have read and understood this disclaimer and that you will not rely on the Service as a substitute for professional medical advice.

4. Account registration & responsibilities

4.1 Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account. By creating an account, you represent that you are a parent, legal guardian, or authorized caregiver of the child(ren) whose information you enter into the App.

4.2 Account security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Use a strong, unique password for your account
  • Notify us immediately at support@yourpottypal.com if you become aware of any unauthorized access or security breach
  • Not share your account credentials with others
  • Not create accounts on behalf of, or impersonate, another person

4.3 Accuracy of information

You are responsible for the accuracy and completeness of information you provide to the Service, including child profile data, potty training logs, and caregiver notes. Inaccurate data may affect the quality of AI-generated coaching and pattern detection.

5. Subscriptions, billing & free trials

5.1 Subscription plans

YourPottyPal offers subscription-based access through two tiers: Regular and Pro. Each tier is available with weekly, monthly, or annual billing cycles. Current pricing is available at yourpottypal.com/pricing. All prices are in USD unless otherwise specified.

5.2 Free trial

Every plan includes a free 7-day trial. During the trial, you have full access to all features in your chosen plan. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription, and your payment method will be charged at the applicable subscription rate.

5.3 In-app purchases through Apple & Google

If you purchase a subscription through the Apple App Store or Google Play:

  • Payment will be charged to your App Store or Google Play account at confirmation of purchase (or when the free trial ends)
  • Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period (exact timing may vary by platform and region)
  • You can manage and cancel your subscription at any time through your App Store or Google Play account settings
  • Free trials automatically convert to paid subscriptions unless cancelled before the trial ends
  • We do not have access to your full payment card information — billing is handled entirely by Apple or Google
  • Refund requests are processed by Apple or Google under their respective refund policies, except where local consumer protection law requires otherwise

5.4 Price changes

We may change subscription prices from time to time. Price changes will be communicated in advance and will not affect your current billing period. Continued use after a price change takes effect constitutes acceptance of the new pricing. You may cancel before the new price takes effect.

5.5 Auto-renewal disclosures

In compliance with the California Automatic Renewal Law (ARL) and similar state and international consumer protection laws:

  • Your subscription will automatically renew at the end of each billing period at the then-current rate unless you cancel
  • Cancellation is available at any time through your App Store or Google Play subscription settings
  • You will receive a confirmation at the time of your initial subscription clearly stating the renewal terms
  • No penalty applies for cancellation

6. User-generated content & data exports

You retain ownership of all content you create within the Service, including potty training logs, caregiver notes, and voice recordings.

  • You are responsible for all information you enter, including its accuracy and appropriateness
  • You grant us a limited, non-exclusive license to use your content solely to provide and improve the Service (e.g., processing logs to generate coaching tips)
  • Voice recordings are stored exclusively on your device — we have no access to them
  • If you choose to export or share a report (CSV/PDF) with a pediatrician or other third party, that sharing is initiated and controlled entirely by you. We are not responsible for third parties' handling of information you share outside the Service
  • You agree not to enter content that is unlawful, harmful, threatening, abusive, or otherwise objectionable

7. Prohibited uses

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation
  • Provide medical advice, diagnosis, or treatment based on information from the App
  • Allow a child to create an account or directly enter personal information into the App
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or our systems
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Copy, modify, distribute, or create derivative works based on the Service without written permission
  • Use automated means (bots, scrapers) to access the Service
  • Transmit viruses, malware, or other harmful code
  • Use the Service for any commercial purpose unrelated to its intended use
  • Misrepresent your identity or your relationship to a child whose data you enter

8. Intellectual property

All content, design, code, graphics, logos, icons, animations, trademarks, trade names, and other intellectual property within the Service are the property of YourPottyPal or its licensors and are protected by copyright, trademark, and other intellectual property laws.

“YourPottyPal,” the YourPottyPal logo, and related marks are trademarks of YourPottyPal. You may not use these marks without our prior written permission. Nothing in these Terms grants you any right, title, or interest in the Service or its content beyond the limited right to use the Service in accordance with these Terms.

9. Third-party services & links

The Service integrates with or contains links to third-party services, including:

  • Apple App Store & Google Play: Subscription billing, payment processing, and refunds are governed by Apple's and Google's respective terms and policies
  • Apple HealthKit / Siri / Shortcuts: Optional iOS integrations that operate under Apple's terms and privacy policies
  • Supabase: Cloud infrastructure for authentication and data storage, operating as our data processor under a data processing agreement

We are not responsible for the availability, content, or practices of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Without limiting the foregoing, we do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the results obtained from the Service will be accurate or reliable; (c) the quality of any information obtained through the Service will meet your expectations; or (d) any errors in the Service will be corrected.

Some jurisdictions do not allow the exclusion or limitation of certain warranties. In those jurisdictions, the above disclaimers apply only to the extent permitted by applicable law. Nothing in these Terms affects your statutory rights as a consumer.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • YourPottyPal, its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, goodwill, or business opportunity, regardless of the cause of action or the theory of liability
  • Our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms will not exceed the amount you have actually paid us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty U.S. dollars ($50), whichever is greater
  • We are not liable for any actions you take or decisions you make based on information provided by the Service, including AI-generated tips, pattern detections, and escalation alerts
  • We are not liable for any harm, loss, or damage resulting from your decision to share data exports with third parties

Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages. In those jurisdictions, these limitations apply only to the extent permitted by applicable law. In the European Union, United Kingdom, and other consumer-protection jurisdictions, nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by mandatory law.

12. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless YourPottyPal, its officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service in violation of these Terms
  • Your violation of any applicable law or regulation
  • Any content you submit, post, or enter through the Service
  • Your reliance on the Service as a substitute for professional medical advice
  • Any dispute between you and a third party with whom you shared data exports

This indemnification obligation does not apply where prohibited by law, including in jurisdictions where consumer protection laws prohibit indemnification clauses in consumer contracts (e.g., EU/UK).

13. Dispute resolution & arbitration (United States)

13.1 Informal resolution

Before initiating formal dispute resolution, you agree to contact us at legal@yourpottypal.com and attempt to resolve the dispute informally for at least 30 days.

13.2 Binding arbitration

If you reside in the United States and we are unable to resolve a dispute informally, you and YourPottyPal agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, rather than in court, except that either party may bring claims in small claims court if the claims qualify. The arbitration will be conducted under the rules of the American Arbitration Association (AAA) or a comparable arbitration provider.

13.3 Class action waiver

YOU AND YOURPOTTYPAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

13.4 Opt-out

You may opt out of this arbitration agreement by sending written notice to legal@yourpottypal.com within 30 days of first agreeing to these Terms. The notice must include your name, email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other aspect of these Terms.

13.5 International users

This arbitration provision applies only to users in the United States. If you reside outside the United States, the dispute resolution and governing law provisions in Section 14 apply. Nothing in these Terms limits your rights under mandatory consumer protection laws in your jurisdiction, including but not limited to EU, UK, Canadian, Australian, Brazilian, Korean, or Japanese consumer protection legislation.

14. Governing law & jurisdiction

14.1 United States users

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Subject to Section 13 (Arbitration), any legal proceedings will be conducted in the state or federal courts located in Florida.

14.2 European Economic Area & United Kingdom

If you are a consumer in the EEA or UK, nothing in these Terms deprives you of the protection afforded by mandatory provisions of the law of your country of habitual residence. You may bring proceedings in the courts of your country of habitual residence. If you are a consumer in the EU, you may also make use of the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14.3 Other jurisdictions

If you reside outside the United States and the EEA/UK, these Terms are governed by the laws of the State of Florida, except to the extent that mandatory local consumer protection laws in your jurisdiction apply and cannot be overridden by contract. Nothing in these Terms limits any rights you may have under applicable mandatory consumer protection legislation.

15. Termination

15.1 Termination by you

You may stop using the Service and delete your account at any time through the App (Settings > Account > Delete Account) or by contacting support@yourpottypal.com. Deleting your account does not automatically cancel an active subscription — you must cancel through your App Store or Google Play subscription settings to stop future charges.

15.2 Termination by us

We reserve the right to suspend or terminate your access to the Service if you materially violate these Terms, use the Service in a manner that could damage our business or reputation, or for any other reason with reasonable notice. In cases of serious violation, termination may be immediate.

15.3 Effects of termination

Upon termination:

  • Your right to access the Service ceases immediately
  • We will delete your personal data in accordance with our Privacy Policy (within 30 days for account data, 90 days for encrypted backups)
  • You may request an export of your data before deletion
  • Provisions that by their nature should survive termination will remain in effect, including Sections 3, 8, 10, 11, 12, 13, 14, and 18

16. Accessibility

We are committed to making the Service accessible to all users. We design and develop the App and Website in alignment with WCAG 2.1 Level AA guidelines and work to ensure compatibility with assistive technologies including VoiceOver, Dynamic Type, and other platform accessibility features.

If you encounter an accessibility barrier, please contact us at accessibility@yourpottypal.com. We welcome your feedback and will work to address issues promptly.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes:

  • We will update the "Last updated" date at the top of this page
  • We will notify you by email and/or by prominent notice within the App at least 30 days before material changes take effect
  • Where required by law, we will obtain your renewed consent before the updated Terms take effect

Continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes, except where applicable law requires express consent. If you do not agree to the updated Terms, you must stop using the Service before the changes take effect.

18. General provisions

  • Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and YourPottyPal regarding the Service, superseding any prior agreements.
  • Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
  • Waiver: The failure of YourPottyPal to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
  • Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms freely in connection with a merger, acquisition, or sale of assets.
  • Force majeure: We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, acts of war or terrorism, epidemics, government actions, or internet service failures.
  • No third-party beneficiaries: These Terms do not confer any rights or remedies on any third party, except as expressly provided.
  • Headings: Section headings are for convenience only and do not affect the interpretation of these Terms.
